GENERAL TERMS AND CONDITIONS OF PURCHASE AND USE OF THE GIFT BOX

 

 

What the Gift Box Is
The Gift Box is a package containing a unique identification code printed on a wooden card (hereinafter referred to as the “Card”), which can be purchased online through the website www.ilborroconcept.com (hereinafter generally referred to as the “Site”) and may be used—personally or as a gift for a third party—to access the services associated with the purchased Card (the “Experience”).
Each type of Gift Box, together with its Card, corresponds to a specific type of Experience and entitles the holder to certain services, which are specifically described on the relevant product page of the Site, as well as in the purchase confirmation email and in the descriptive brochure included in the box sent to the recipient.
Once the purchase of the Gift Box is completed, the box containing the Card will be sent to the recipient’s address provided by the Purchaser at the time of purchase. The Card will be immediately usable to book the Experience with the Partners (i.e., those providing the services included in the Experience), following the instructions in the brochure, with no need for prior activation of the unique code, which will already be active from the moment the box is shipped.

The Gift Box is issued by DAL BORRO S.r.l., with registered office in Loro Ciuffenna (AR), San Giustino Valdarno, Viale Europa n.23, ZIP 52024, Tax Code and VAT No. 01692160516 (hereinafter referred to as “Dal Borro” or “Supplier”), owner of the Site, which publishes and markets various types of Experiences on behalf of its Partners. The Gift Box is sold on the Site by DROP Srl, based in Montegranaro (FM), 63812, via Sandro Pertini n.1, Tax Code and VAT No. 01383870431 (hereinafter “Drop” or “Seller”).
The purchase and use of the Gift Box are governed by the General Terms and Conditions of Purchase and Use set out below.

The provision of the services associated with the Experience bookable using the unique identification code on the Card is instead governed by the general conditions set by the respective Partner providing the services, as described in the brochure included in the Gift Box. For all matters concerning the provision and use of the services linked to the unique identification code on the Card, reference is made entirely to the specific general conditions of the Partners mentioned above.

Purchase Procedure for the Gift Box
A customer wishing to purchase a Gift Box (hereinafter the “Purchaser”) must place an online order with the Seller, selecting the desired type of Gift Box from those offered on the Site and adding it to the shopping cart.
At the time of purchase, in addition to their personal details and email address, the Purchaser must also provide the full name and address of the recipient to whom the Gift Box will be sent. It is the Purchaser’s responsibility to ensure that the correct address for delivery is entered; in the case of an incorrect address, no liability can be attributed to the Seller.

A summary document, including the selected Experience and its price, order details, shipping costs, and chosen payment method, will allow the Purchaser to verify the order data and make any necessary changes before the final submission.
To proceed with the order, the Purchaser must click on the “Proceed to Checkout” button.
For creating a personal account, reference is made to Article 3 of the General Terms and Conditions of Sale available in the dedicated section in the Site footer.
The Gift Box can be purchased using all payment methods provided on the Site.
The sale is considered final only after acceptance of the payment method used and receipt of the full payment by the Seller.

By submitting the order form, the Purchaser confirms that they are aware of and unconditionally accept these General Terms and Conditions governing the purchase and use of the Gift Box, the General Terms and Conditions of Sale published in the Site footer, and the Privacy Policy. Therefore, before proceeding with the order, the Purchaser will be required to carefully read the General Terms and Conditions of Purchase and Use of the Gift Box and the General Terms and Conditions of Sale (which they may print or save for personal use).

No discounts or promotions of any kind, including offers on the Site, may be applied to the purchase of a Gift Box, which in any case are valid only for direct purchase of products sold on the Site.
After final confirmation of the order, the Seller will send an order confirmation email to the Purchaser containing all relevant information. By printing and/or saving this email, the Purchaser will have proof of the order, and the Gift Box, i.e., the box containing the Voucher associated with the selected Experience, will be sent to the recipient address provided at the time of purchase.

The order confirmation email must be retained by the Purchaser and, if necessary, forwarded to the Gift Box recipient. This email will be required by the Seller and/or the Supplier’s Partners as proof of purchase in cases of fraud, theft, loss, or disputes regarding the Experience associated with the purchased Gift Box, as well as for exercising the Purchaser’s right of withdrawal under applicable law.

Right of Withdrawal
The Purchaser, as a consumer under Legislative Decree no. 206/2005, may exercise the right of withdrawal within 14 (fourteen) days from the date of delivery of the Gift Box to the recipient, according to the procedures indicated in Article 14 of the General Terms and Conditions of Sale available in the dedicated section in the Site footer, except as exclusively applicable to the withdrawal from the purchase of products other than the Gift Box.

The right of withdrawal for a Gift Box purchase is exercisable only if the unique identification code on the Card has not yet been used to book the Experience.
To exercise the right of withdrawal, the Purchaser must indicate the unique identification code on the Card or provide a copy of the order confirmation email and return, or ensure the recipient returns—following the instructions received under Article 14 of the General Terms and Conditions of Sale published on the Site—the box containing the Card and descriptive brochure. If, for any reason, returning the box is not possible, a value of €30.00 (thirty/00) will be deducted from the refund due to the Purchaser.

In the event of withdrawal from a Gift Box purchase, once the withdrawal notice has been received and it is verified that the unique code on the Card has not been used, the Seller will refund the purchase amount as soon as possible and, in any case, within fourteen (14) days from the date the Seller became aware of the withdrawal. The refund will be made using the same payment method used for the Gift Box purchase.
Upon receiving notice of the exercise of the right of withdrawal from the Purchaser, and after verifying that the Voucher has not been used, an email will also be sent to the Gift Box Beneficiary informing them that, due to the exercise of the Purchaser’s right of withdrawal, the Voucher received is no longer usable.

Use of the Gift Box
Once the order is completed, the Purchaser will receive a confirmation email containing the order summary. At the same time, the Gift Box—containing the Card and descriptive brochure—will be shipped to the recipient at the address provided by the Purchaser at the time of purchase. The unique identification code on the Card is immediately active and requires no activation.

To book the Experience with the Supplier’s Partners using the unique code on the Card, the booking procedure specified in the general conditions in the brochure included in the Gift Box must be followed. The unique code on the Card must be provided during the booking.
The Gift Box must be used in a single session and only at the Partner indicated in the brochure, cannot be combined with other offers, is non-refundable, and cannot be exchanged for cash.

At the time of service delivery for the Experience, the Card (the wooden card in the Gift Box) must be presented and will be collected by the Partner’s operator.
Booking the Experience with the Partner is mandatory and subject to availability; the Experience can be booked from Monday to Sunday, excluding holidays, according to availability.
The booking and provision of services related to the booked Experience are governed by the general conditions in the brochure included in the Gift Box.
The Partner is solely responsible for the proper execution and conformity of the services provided for the booked Experience.

The Card in the Gift Box is a bearer instrument. Therefore, if it is misused, lost, stolen, and/or damaged and rendered unusable, it cannot be blocked, replaced, or refunded.
Furthermore, no liability can be attributed to the Seller and/or Supplier for any improper or fraudulent use of the Card contained in the Gift Box.
The risk of loss and ownership of the Card transfers to the Purchaser and/or recipient at the time of sending the order confirmation email and at the time of receipt of the Gift Box, respectively.
Gift Boxes obtained through any fraudulent or illegal means will be considered null and void and therefore cannot be used to book Experiences with the Supplier’s Partners.

Validity Period
The unique identification code on the Card in the Gift Box is already active at the time the box is shipped to the recipient and is valid for one (1) year from the date of purchase of the Gift Box by the Purchaser. After this period, the Card will be considered expired and cannot be used to book the Experience associated with the Gift Box, nor can it be redeemed for cash.
The purchase date is that indicated in the order confirmation email sent to the Purchaser and also shown in the brochure included in the Gift Box sent to the recipient.

Privacy and Personal Data Processing
Information regarding the processing of personal data is provided in the dedicated Privacy Policy, also accessible in the “Privacy Policy” section of the Site, which is considered an integral part of these General Terms and Conditions of Purchase and Use.

Applicable Law, Online Dispute Resolution, and Competent Court
